New California bill requires enhanced data breach notifications

Governor Jerry Brown has signed into law a bill that enhances California’s data breach notification law requirements.  The new enhancements require that breach notification letters contain the specifics of the incident, including the type of personal information that has been exposed, a description of what happened, and in some circumstances steps that a person can take to protect himself or herself from identity theft. The law also requires that organizations that sustain a breach affecting 500 or more people submit a copy of the alert letter to the California attorney general’s office.  Unless there is an exception under the relevant circumstances, an organization that stores personal information must send out notification letters as soon as it discovers a security breach in which unencrypted personal information was or is reasonably believed to have been acquired by an unauthorized person.  For additional information, see Senator Simitian’s announcement Click Here or a copy of the bill (SB-24) Click Here.
